Supreme Court Dismisses Udeze’s Appeal Against Expulsion from  Action Alliance

The Supreme Court yesterday dismissed the appeal filed by Mr Kenneth Udeze challenging his suspension and subsequent expulsion from the Action Alliance (AA).

 

In a unanimous judgment delivered by Justice Garba Lawal on behalf of the five-member panel of justices, the apex court threw out Udeze’s appeal.

 

Udeze, who had been suspended and expelled from the National Think Tank committee, the highest ruling organ of the party, had approached the Supreme Court to appeal against the judgment of the Abuja division of the Court of Appeal delivered in November 2023. This judgment upheld the Federal High Court, Abeokuta’s ruling in favor of Mr Awofala Awoniyi and the Action Alliance.

 

 

The Federal High Court, Abeokuta, in its judgment delivered on September 8, 2023, validated Udeze’s suspension and expulsion from the party. The court also held that a member who has been suspended or expelled from the party lacks the locus standi to hold any leadership position in any political party.

 

The Abuja division of the Court of Appeal, while hearing Udeze’s appeal, declared that the appeal lacked merit and there was no basis for it.

 

Not satisfied with the judgments of the two appellate courts, Udeze approached the Supreme Court. However, the matter was eventually dismissed.

 

With the Supreme Court’s judgment delivered on Monday, Udeze has suffered another setback in his quest to lead the AA as its National Chairman.
